1. Introduction

Welcome to Captivate.ly, a mobile application developed and operated by ANIPSIA. These Terms and Conditions (“Terms”) govern your use of Captivate.ly and its associated services, including AI-generated caption suggestions and publishing tools integrated with third-party platforms.

By downloading, accessing, or using Captivate.ly, you agree to be bound by these Terms. If you do not agree, please do not use the app.

2. Definitions

• “We” / “Us” / “Our” refers to ANIPSIA, the provider of Captivate.ly.

• “You” / “User” refers to any individual or organization using Captivate.ly.

• “App” / “Captivate.ly” refers to the Captivate.ly mobile application and all its features.

• “Content” refers to any text, image, or media you upload or publish using the App.

3. Eligibility

You must be at least 18 years old or of legal age in your jurisdiction to use Captivate.ly. By using the App, you confirm that you meet these requirements.

4. License to Use the App

We grant you a limited, non-exclusive, non-transferable license to download and use Captivate.ly solely for its intended purposes and in accordance with these Terms.

You may not:

• Reverse-engineer, decompile, or tamper with the app’s code.

• Use Captivate.ly for unlawful, harmful, or fraudulent purposes.

• Resell, sublicense, or commercially exploit any part of Captivate.ly without permission.

5. Third-Party Services and APIs

Captivate.ly integrates with third-party platforms and APIs, including but not limited to:

• Google Gemini (for AI-generated captions)

• Instagram Graph API

• LinkedIn API

By using Captivate.ly, you:

• Acknowledge that your use of Instagram and LinkedIn is subject to their own terms and conditions.

• Authorize Captivate.ly to post content on your behalf to these platforms via their respective APIs.

• Understand that API uptime and availability are outside our control.

We disclaim all liability for service outages, changes, or errors caused by these third-party services.

6. AI-Generated Content Disclaimer

Captivate.ly uses large language models (LLMs) to generate suggested captions. These outputs:

• May contain errors, inaccuracies, or unintended messaging.

• Are not guaranteed to be complete, factual, or appropriate.

You remain solely responsible for reviewing, editing, and approving all captions before publishing. We assume no liability for the use or consequences of AI-generated content.

7. User Responsibilities and Content Restrictions

You agree not to use Captivate.ly to upload, store, or distribute any content that is:

• Illegal or prohibited in your jurisdiction.

• Harmful, hateful, violent, pornographic, or related to child sexual abuse material (CSAM).

• Promoting drugs, terrorism, or discrimination.

We reserve the right to restrict your access to the App and cooperate with law enforcement agencies if such misuse is detected. Where required by law, we will provide identifying information of users in response to legitimate legal requests.

8. Temporary Image Hosting

To facilitate posting, uploaded images are temporarily hosted in a secure image bucket for up to 24 hours. These URLs are:

• Anonymized and unlisted.

• Deleted automatically after expiration.

By using Captivate.ly, you consent to this processing as part of the posting workflow.

9. Acceptable Use

You agree not to:

• Abuse, interfere with, or disrupt the App or its servers.

• Impersonate any person or entity.

• Attempt to gain unauthorized access to data or systems.

10. Ownership and Intellectual Property

All intellectual property rights in Captivate.ly and its components remain the property of ANIPSIA or its licensors. You retain ownership of any content you upload, but grant us a limited right to use it solely for the purposes of caption generation and post submission.

11. Limitation of Liability

To the fullest extent permitted by law:

• Captivate.ly is provided “as is” without warranty of any kind.

• We are not responsible for any direct, indirect, incidental, or consequential damages resulting from your use of Captivate.ly or reliance on AI-generated content.

• We make no guarantees about uptime or service continuity, particularly regarding third-party API dependencies.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to conflict-of-law principles.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Lugano, Switzerland.

13. Changes to These Terms

We reserve the right to update these Terms from time to time. Significant changes will be notified via the app or email. Continued use of Captivate.ly after such changes constitutes your acceptance.
